- "User" means any person who uses the website or purchases goods through it.
- "Trader" means the operator of the website acting under the "Prodai BG" brand.
- "Goods" means any product offered for sale through the website.
- "Product with transport damage" means goods with described and/or visible cosmetic or packaging imperfections arising during transport or storage, which are not hidden and are expressly disclosed in the listing.
3. Conclusion of Contract
The distance sale contract shall be deemed concluded from the moment the order is confirmed by the trader. Submission of an order by the user constitutes an offer to enter into a contract. The trader has the right to request additional confirmation by phone or email before fulfilling the order.
4. Order Placement
- The user selects a product, enters the necessary delivery details, and chooses a payment method.
- Before finalizing the order, the user has the opportunity to review and correct the entered information.
- The trader reserves the right to refuse an order in the event of an obvious technical error, lack of availability, incomplete information, or suspected abuse.
5. Prices and Payment
All prices on the website are in euro. The prices announced at the moment the order is confirmed shall apply to the specific purchase, except in the case of an obvious technical error. Payment may be made by card through Stripe, by bank transfer, or by cash on delivery where this option is available for the specific order.
6. Delivery
Delivery is made within the territory of the Republic of Bulgaria through courier partners. The usual delivery period is 2 to 5 business days, unless otherwise stated for a specific product. Delays are possible during busy periods, public holidays, adverse weather conditions, or for reasons beyond the trader's control.
7. Inspection Upon Receipt
The user should inspect the condition of the shipment upon receipt. If visible transport damage, missing items, or discrepancies are found, it is recommended that they be noted in the presence of the courier and that the trader be notified immediately.
8. Right of Withdrawal
The user has the right to withdraw from the distance contract within 14 days of receiving the goods, in accordance with the applicable Bulgarian consumer protection legislation, except in the cases excluded by law.
The goods should be returned in good saleable condition, without signs of use beyond what is necessary to establish their nature, characteristics, and proper functioning. If the value of the goods has been reduced as a result of use beyond that scope, the trader may claim appropriate compensation.
9. Special Terms for Products with Transport Damage
For products with transport damage, the specific cosmetic imperfections, traces on the packaging, or other visible signs shall be considered part of the individually advertised condition of the goods when they are described or shown on the website. These features shall not constitute a lack of conformity if they were disclosed in advance.
The user's statutory rights in the event of functional non-conformity, a hidden defect, or non-conformity with the advertised characteristics are not limited. If the delivered product does not correspond to the described condition, the user has the right to submit a complaint under the general procedure.
10. Complaints and Warranty
The statutory liability for conformity under the applicable Bulgarian legislation shall apply to consumer goods. Where a commercial warranty from the manufacturer or supplier applies, its terms shall apply alongside the statutory rights and shall not replace them.
11. Limitation of Liability
The trader shall not be liable for damages caused by improper use, installation, storage, overloading, use for unintended purposes, intervention by unauthorized persons, or failure to follow the manufacturer's instructions. The website may be temporarily unavailable due to technical maintenance, external factors beyond control, or force majeure circumstances.
12. Intellectual Property
All texts, images, graphics, logos, and content on the website are protected and may not be used without prior written consent, unless otherwise permitted by law.
13. Dispute Resolution
Disputes shall be resolved by mutual agreement, and where this is not achieved, by the competent Bulgarian court. Users may also submit a complaint to the Consumer Protection Commission and may use the European online dispute resolution platform where applicable.
14. Applicable Law
For all matters not settled herein, the legislation in force of the Republic of Bulgaria and the applicable law of the European Union shall apply.
15. Amendments to the General Terms
The trader reserves the right to update these general terms. The new version shall enter into force upon its publication on the website, unless otherwise stated.
